The services provided by STOWLUGGAGE.COM of XHUB SRLS are governed by these "Terms and Conditions of Service". The "Terms and conditions of service" established by STOWLUGGAGE.COM of XHUB SRLS must be understood and considered an integral part of each single deposit contract and of any other service concluded with the Customer and cannot be separated from the contract itself.
The following definitions apply to the "Terms and Conditions of Service" which govern the deposit agreement and for any other service concluded with the customer: "we", "us", "our", the "personnel in charge" means XHUB SRLS and any partners and collaborators of XHUB SRLS ; "Customer / s", "you" and "your" means the customer holding a reservation.
The contract for the deposit and for other services is stipulated with the company XHUB SRLS. owner of the registered trademark "Parkyourbags.com" and of the website www.stowluggage.com, which agrees to keep the luggage/objects of its customers in its luggage storage. By leaving your luggage on our premises and in the luggage room, you accept the terms and conditions set out in our storage agreement and/or in the agreement for the provision of various services, on your behalf and/or on behalf of any other interested person.
The left luggage service consists of the rental of automatic lockers for the safekeeping of luggage / personal items in our shops for the period chosen by the customer during the booking process. The Customer is informed that he has no right of withdrawal from the transaction, which he expressly renounces in light of the specificity of the service, and that the reservation is non-refundable. The confirmation Email that STOWLUGGAGE.COM sends to the customer constitutes the reservation. The offices are open seven days a week. Working hours may vary depending on the left luggage, so please check it again on each specific page dedicated to the single left luggage. Reservations can be made on the website 24 hours a day. Animals are prohibited in all lockers and/or in all premises. Smoking is not permitted in our baggage storage. Access (to the service) is limited to persons over the age of 18 or accompanied minors. No storage of perishable foods is allowed inside the lockers. The Customer is required to check the dimensions of his baggage before making a reservation on the site. No claim or refund request will be accepted if the baggage exceeds these dimensions and/or weight. The Client is also required to make sure that the locker door is tightly closed before leaving the left luggage he/she has used; The baggage is locked inside the locker rented by the customer; He has not left valuables in his luggage, for which the Customer remains responsible and for which XHUB SRLS. - STOWLUGGAGE.COM declines all responsibility; He has not left anything inside the locker when leaving a STOWLUGGAGE.COM deposit for the last time (at the end of the reservation). The Customer is in any case responsible for his own luggage and its contents. It is the Customer's responsibility not to leave any identity document or other document necessary for the trip in the locker. The Client acknowledges that he has taken all the necessary precautions and measures to ensure that he has not left the documents necessary for the trip in the locker. Failing that, XHUB SRLS. – STOWLUGGAGE.COM in no case can be held responsible for any negligence on the part of the Customer.
In case of late baggage collection during opening hours, XHUB SRLS. STOWLUGGAGE.COM will charge a supplement for each hour of delay. At the end of the payment the Customer can collect the luggage. If the collection does not (take place) it took place before the shop closing time, but on the following day (or days), XHUB SRLS. – STOWLUGGAGE.COM will charge an additional daily cost for each day of delay. At the end of the payment, the Customer can collect the luggage. If, during the rental or at the end of the same, the locker is not closed correctly by the customer, a penalty of € 25.00 will be charged by the company. In the event that the locker, once the baggage has been collected, is left in such hygienic conditions as to require complete cleaning, the amount of € 25,00 will be applied as a penalty for cleaning and disinfection costs.
For security reasons, any item or baggage that is forgotten/found and not claimed will be destroyed after 5 days from the end of the reservation. If the forwarding of a forgotten item is requested, the Customer assumes all costs, which must be paid in advance. A contribution of €35 will be requested plus shipping costs, which depend on the weight, destination and shipping method (ordinary mail, UPS, etc.).
The storage of items prohibited by law and/or considered dangerous under national legislation, as well as items which by their nature or packaging may cause damage to people, the environment or other transported and/or stored baggage, is not permitted. We do not accept warehousing, or provide any other services, for goods which in our sole discretion are deemed dangerous.
Does not accept deposit for the following items:
The following items may be accepted by XHUB SRLS. - STOWLUGGAGE.COM only with specific written authorization or if they are expressly part of the commercial offer of XHUB SRLS. STOWLUGGAGE.COM food and pharmaceutical products; cigarettes and alcohol; fragile items (such as glass, bottles, etc.); biological tissues and anatomical pieces. The customer acknowledges and accepts that the storage of such goods is subject to specific regulations. The assignment must therefore take place in compliance with current legislation and any operational provisions dictated by XHUB SRLS. PARKYOURBAGS.COM. These indications may vary at any time.
The customer guarantees and declares that: A. full address and contact details have been accurately reflected on the online booking; B. the contents of the baggage do not cause damage to other baggage transported by us and/or stored in our warehouses; C. the contents of your Baggage are not a prohibited item and you are a person or organization with whom we cannot lawfully trade under applicable law or regulation; D. when you have requested to charge a third party the deposit fee, in the event of non-payment, you will be obligated to pay the service fee; E. all applicable laws and regulations have been complied with, in addition to the provisions of this agreement; F. the economic value of the contents of each locker does not exceed €200.00 G. The customer hereby agrees to indemnify and hold us harmless from any liability we may suffer, or from any costs, damages or expenses, including legal fees, which we may incur for you or any third party arising out of your breach of any of the of these guarantees, obligations and guarantees set forth in this agreement, even if we inadvertently accept a storage that contravenes any of your obligations.
Our liability for the risk of loss or damage to your baggage during the period of custody at our office and specifically attributable to the sole responsibility of XHUB SRLS. or its employees, will be governed by art. 1768 and no. 1770 civil code and in any case cannot, under any objective and/or subjective circumstances, exceed the amount of € 200.00 per locker, covered by the insurance referred to in point 10 of these conditions. For the part not contemplated therein by the provisions of the code civil law on the deposit contract, no liability is attributable to XHUB SRLS. in case of baggage/baggage delayed and/or not collected beyond the opening/closing hours of our premises. Therefore, XHUB SRLS. will not be in any way responsible for duly and fully proven damages, which may be considered a direct and foreseeable or indirect consequence of the delay and/or failure to collect. XHUB SRLS. shall therefore not be liable for any flights, trains, goodwill, lost profits, profit, market, reputation, customers, use, opportunity, even if we were aware that such loss or damage might occur, nor for any loss or damage, regardless of damages indirect, incidental, special or consequential causes, including, without limitation, cases of termination of contract, negligence, willful default or non-performance. We will not be liable if we fail to perform any obligation to you due to circumstances beyond our control such as (the list below is illustrative only and not exhaustive): Acts of God including earthquake, cyclone, storm, flood, fire , disease, fog, snow or frost; force majeure including (but not limited to) war, accidents, acts of terrorism, strikes, embargoes, local disputes or popular uprisings; national or local outages; hidden defects or defects intrinsic to the contents of the checked baggage; criminal acts by third parties such as theft, robbery and arson; acts or omissions attributable to you or to third parties whose work you will be responsible for; act or omission attributable to a public official; content of the shipment consisting of any item which is an item prohibited by law or under the provisions of this contract, even though we may have accepted the shipment and/or deposited in error. We are not responsible for broken handles and/or wheels. The only responsibility attributable to us in relation to the services provided is governed by these general conditions of conservation. INSURANCE Each locker at our company is covered by ITALIANA ASSICURAZIONI insurance up to a maximum value of EUR 1000.00 per locker. This insurance coverage will compensate the customer for any damages and/or losses directly attributable to XHUB SRLS. – STOWLUGGAGE.COM within the limits indicated above, as well as in the event of proven theft by third parties. This insurance coverage is not available for precious stones, precious metals, watches, plasma screens, LCDs, satellite navigation systems, mobile phones, PCs, tablets, jewelry, money, glass, porcelain, works of art, antiques, documents or films, tapes, records, memory cards or any other medium containing data or images. The above insurance options do not cover consequential loss, delayed delivery or losses arising from a breach of your obligations under these terms and conditions and are not available for services which do not involve carriage. The above options do not cover broken handles and/or wheels. All shops are controlled with an alarm system linked to local authorities and private surveillance; in addition, all the shops are equipped with 24-hour video surveillance, connected to a network with a private control and surveillance centre. If a customer wishes to file a complaint for loss or damage to baggage, or for any other damage, he must comply with the provisions of the national law; otherwise, we reserve the right to reject the complaint. In particular, you can submit your complaint in writing within eight (5) calendar days from the locker rental end date. After the first written communication, and no later than the limitation period established by the law or by the applicable regulations, the customer must provide documentary evidence of the claim by sending all the useful information relating to the accident. We are under no obligation to act on any claim until our filing fees and charges have been paid. The customer has the right to deduct the amount of the claim from the amounts due for the rental to XHUB SRLS. In order to take account of a claim for damages, the contents of your baggage will be made available to us for inspection upon collection. If we accept your claim, you warrant that the insurance company or any third party having an interest in the retention will waive any rights or claims they may have under subrogation or otherwise.
For the automatic locker rental service, the charge will be made on the credit card at the time of online booking. This charge will include the cost of the rented time slot. If the customer, as provided for in point 2, should be late in collecting his goods, the additional hourly/daily rate will be charged. Payment of this excess will be required in order to access your assets. Any disputes relating to charges must reach us in writing no later than seven (3) days from the date of payment. The current rates applicable to the deposit service are available on our website. The customer agrees to pay the amount due to XHUB SRLS. – STOWLUGGAGE.COM governed by these conditions within the agreed terms. Payments will be made in the local currency, and calculated according to the current exchange rate. Payment delays may result in the application of default interest pursuant to Legislative Decree no. 231/02 and subsequent amendments. XHUB SRLS.. – STOWLUGGAGE.COM reserves the right to demand, without prejudice, the reimbursement of its credits in the times and in the ways established by law, without prejudice to the right to greater damages.
If any term or condition of this Agreement is determined to be invalid or unenforceable, such determination shall not affect the other provisions of this deposition agreement which shall then remain in full force and effect. Except for the provisions of any applicable law; any dispute deriving from and/or connected to this deposit agreement will be governed by Italian law.
For any dispute relating to the relationship between the parties, the consumer court will have exclusive jurisdiction pursuant to article 33 paragraph 2 of legislative decree number 206/2005 and subsequent amendments.
